CHAIR JUDICIAL INDEPENDENCE 1995-2010
From its inception ARMSA was involved in issues of judicial independence. Many Regional Magistrates had made submissions to the Hoexter Commission in the early 1980’s and were disappointed when its recommendations were brushed aside. Many members also considered that there were major shortcomings in the Magistrates Act, which was passed by parliament in 1993 and took effect in March 1994, shortly before the first democratic elections took place. In particular the Regulations promulgated under the Act were seen as retrogressive in many ways.
