SYMPOSIUM ON THE CHILD IN THE CRIMINAL JUSTICE SYSTEM

On Youth Day, 16 June 2004, a symposium was held by the Centre for Child Law, Law Faculty, University of Pretoria, in conjunction with the Association of Regional Magistrates of SA (ARMSA). The symposium was attended by approximately 45 participants, including magistrates, regional magistrates, lawyers, prosecutors, and social workers.Ms SR Monaledi, Regional President, North-West, acted as the master of ceremonies
   
Prof IP Maithufi of the South African Law Reform Commission did the opening, followed by a keynote address by Prof Trynie Davel the director of the Centre for Child Law. She dealt with constitutional rights of children, referring also to the impact of the various international human rights instruments on the rights of children.

    

The following papers were presented: Ms Ann Skelton of the Centre for Child Law presented a discussion on the Child Justice Bill. The concept of restorative justice for juvenile offenders was discussed by Mr Mike Batley of the Restorative Justice Centre.  

Ms Maggie Tserere of the National Prosecuting authority did a paper on diversion programmes for juveniles and the National Prosecuting Authority’s guidelines in this regard.  

Ms Lynn Pillay and Ms Jakkie Wessels, Regional Magistrates in Pretoria, discussed the topic “The child as witness”.  Ms Delene Clarke, a senior researcher from the South African Law Reform Commission spoke on the legislative developments regarding sexual offences focusing on child victims
